STANEK Legal lawyers advise and represent Clients in all types of administrative proceedings, both before public administration authorities and regulatory bodies and before the Voivodeship Administrative Courts and the Supreme Administrative Court.

An important part of our practice concerns environmental law, in particular waste management, environmental permits and inspections conducted by environmental protection authorities. The Firm also represents businesses in proceedings where an administrative decision may directly affect their ability to continue operations.

The Firm’s advisory services include in particular:

  • representing Clients during inspections and proceedings before public administration authorities and regulatory bodies;
  • preparing appeals, complaints, applications for reconsideration and other remedies available in administrative proceedings;
  • representing Clients before the Voivodeship Administrative Courts and the Supreme Administrative Court, including preparing cassation appeals and applications for suspension of enforcement of acts or decisions;
  • advising on permits, licences, environmental decisions and other administrative-law requirements applicable to regulated activities;
  • conducting waste-management proceedings, including matters concerning the granting, amendment or withdrawal of permits, inspections by environmental authorities and administrative sanctions for breaches of environmental law;
  • representing Clients before the Polish competition authority (UOKiK), Energy Regulatory Office (URE), Polish Financial Supervision Authority (KNF) and other supervisory or regulatory authorities;
  • carrying out compliance reviews of business operations under environmental regulations and preparing Clients for inspections and post-inspection proceedings.

Selected experience of the Firm’s lawyers:

coordinating administrative strategy with defence in criminal proceedings concerning environmental protection and waste management.

obtaining a favourable judgment of a Voivodeship Administrative Court in a case concerning amendment of a waste-collection permit, where the authority had incorrectly equated the place of business with the entire plot covered by the local zoning plan;

obtaining decisions setting aside refusals to amend waste-collection permits, including matters concerning the requirement to obtain a zoning decision and the classification of an amendment as material;

representing businesses before regulatory authorities, including the Energy Regulatory Office, the Office of Competition and Consumer Protection and the Polish Financial Supervision Authority;

conducting administrative court proceedings in which the key issues included evidentiary standards, the binding effect of a court’s legal assessment on the authority and procedural guarantees of the party;
